If the legal team is weak or not sufficiently motivated, it will be much tougher for the team members to focus on the legal issues. And it is for all the lawyers on the team to identify, flag and mitigate legal risks for the company. The general counsel should absolutely work with those risks as well and prioritize them, together with the corporate leadership team. But the entire team of lawyers is what must be at the forefront of the general counsel’s mind. The good general counsel would only hire lawyers with better legal skills than herself. If she does that, she can be sure that all the worrying about the company’s legal risks is well taken care of.
