I. STATE NOTICES

Elevate is primarily a business-to-business company and does not market its services for personal, family, or household purposes.  Outside of providing services on behalf of our customers, Elevate does not process Personal Information of individuals except for visitors to our website. Elevate may disclose Personal Information to third parties for the following essential business reasons:

1. Applicable personal data processing done under the instructions of our customers.
2. Instructions given to our suppliers regarding HR and payroll data.

Elevate respects the privacy of individuals and is committed to complying with all applicable data protection and privacy laws governing the collection, use, disclosure, and retention of Personal Information.

1. Notice to California Residents (Shine the Light Act)

Elevate does not share Personal Information with third parties for their direct marketing purposes. Once a year, California residents, not otherwise excluded by statute, may request information about the manner in which Elevate shared certain categories of information with others for their marketing purposes during the prior calendar year. 2. Notice to California, Nebraska, and Texas Residents

This section of the Privacy Policy applies to:

• All California residents (including those interacting with Elevate in a commercial or employment context),
• Nebraska and Texas residents who interact with Elevate for personal, family, or household purposes (excluding those who interact with Elevate in a commercial or employment context).

The individuals covered above are referred to as “Consumers” in this section.

The California Privacy Rights Act, the Nebraska Data Privacy Act, and the Texas Data Privacy and Security Act (collectively, the “Privacy Laws”) provide verified consumers with rights regarding their Personal Information. For purposes of this section, Personal Information means information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Your Rights under the Privacy Laws

Information Access Rights

Twice in a twelve-month period, Consumer can request and receive:

1. Confirmation that Elevate holds Personal Information about them and disclosure of its information collection practices during the preceding 12 months, including the categories of data collected and the categories of sources from which the information was collected, the business purpose(s) for the collection or sharing of the information, and the categories of third parties with whom Elevate has shared the information.
2. A copy of the Personal Information Elevate has collected about them during the (a) preceding 12 months, or (b) since January 1, 2022, unless doing so would involve a disproportionate effort.
3. Information disclosure practices during the preceding 12 months, including the categories of collected Personal Information, specific Personal Information collected, and the categories of third parties with whom their Personal Information is shared.

Information Correction Right. Consumers have the right to request that Elevate correct the information Elevate holds that may be inaccurate. Elevate will require that you provide information to verify your identity before making any changes in the information it holds and it will take commercially reasonable efforts to make the requested corrections.

Information Deletion Right. Consumers have the right to request that Elevate delete the information it has collected about them at any time; however, Elevate may retain information in certain instances, such as completing the transaction for which it was collected, detecting security incidents, compliance with legal obligations or applicable laws, and/or other internal uses reasonably aligned with the consumer’s expectations.

Opt Out Rights

Do Not Sell My Personal Information. Consumers over the age of 16 have the right, at any time, to director Elevate not to sell their Personal Information. Elevate does not sell Personal Information to third parties for monetary consideration, but we may transfer information to a third party providing us with services, which may fall under the definition of “other valuable consideration,” which could be considered a “sale” under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. Limit the Use or Disclosure of My Sensitive Personal Information. Consumers have the right to tell Elevate not to process or disclose Sensitive Personal Information (“SPI”) other than purposes permitted by the Privacy Laws, including, but not limited to, performance of a contract, detecting and prosecuting security incidents, fraud, malicious and other illegal activities. Elevate does not collect SPI for marketing purposes.

Nondiscrimination. We will not discriminate against you as a result of exercising any of these rights.

Collection of Personal Information

Elevate does not sell Personal Information to third parties for monetary consideration; however, Elevate may transfer information to a third-party service provider, which may fall under the definition of “other valuable consideration”  and could be considered a “sale.” “Personal information” means information that:  identifies; relates to; describes; is capable of being associated with; or could reasonably be linked, directly or indirectly, with a Consumer. During the past 12 months Elevate has collected the following categories of information from our website visitors for the stated purpose. Any collected data is deleted after 12 months.

Collection and processing of Personal Information from business activities, such as HR recruitment and Personal Information processing under the instructions of our customers, are done to fulfill contractual obligations or by legitimate interest. Personal data retention follows Elevate’s internal retention policies, contractual obligation with our customers, and legal data retention requirements.

3. Notice to Nevada Residents
Elevate does not disclose information for monetary consideration.
