Challenge
A global innovation leader, consistently ranking among the world’s top patent filers, with a portfolio exceeding 100,000 patents, needed to maintain a high volume of global patent filings while improving patent quality, licensing potential, and overall strategic value of its patents. The customer sought stronger, more commercially viable patents rather than simply increasing filing counts.
Achieving this was constrained by several operational and structural challenges:
- High-volume pressure strained internal IP bandwidth and put aggressive filing timelines at risk
- Traditional law firm-led workflows were not designed for the customer’s required high-volume scale, creating bottlenecks in speed and cost efficiency
- Recurring portfolio expansion created significant, ongoing budget pressures across the company
- Limited internal capacity to manage the full patent lifecycle, including drafting, office action responses, and IDS preparation
- Rigid, non-scalable processes could not keep pace with the growing global innovation output
Solution
To support high-volume patent filings without compromising quality or cost efficiency, Elevate implemented a structured, hybrid IP delivery model. This model combined Elevate-led drafting and coordination with legal oversight from a leading US law firm, ensuring a privileged, scalable, and quality-controlled environment.
Elevate operated as an integrated extension of the customer’s in-house lawyers, external counsel, inventors, and subject-matter experts through a structured, privilege-safe workflow that spanned invention scoping to drafting, review, and prosecution support. Key components included:
- Preserved attorney-client privilege by routing all prior-art, IDS materials and supporting documentation through external counsel before sharing them with Elevate’s drafting teams
- Early alignment on invention scope and claim strategy through scoping discussions and inventor interviews, supported by prior-art analysis, before drafting began
- Strengthened defensibility by incorporating full Alice eligibility considerations upfront for 100% of software‑related inventions
- Delivered high-quality, consistent patent drafts by assigning dedicated technical drafting teams and standardising claim structures tailored to case managers
- Reduced rework and accelerated approvals by applying parallel review cycles, enabling our SMEs to validate technical accuracy and alignment between claims, figures, and specifications before final legal review
- Enhanced future infringement potential while ensuring allowability through coordinated reviews by the licensing team and the Office Action response team, ensuring claims are both prosecution-robust and licensing-ready
- Regulatory consistency in prosecution support, including office action responses, specialised patent drawing support, and structured IDS preparation for paralegal teams
- Standardised frameworks and review checkpoints across multiple teams, to improve drafting quality and timelines without increasing internal headcount
